Electronic Apostille (e-Apostille) for Ukrainian Documents
How to get an electronic apostille on Ukrainian documents for use in Spain: criminal record extracts, civil status certificates and diplomas, plus sworn translation.
An e-Apostille is the digital version of the Hague Apostille used for Ukrainian public documents. Instead of a stamped paper certificate, you receive files with a qualified electronic signature, which can be downloaded and verified online. For Ukrainian documents the apostille is issued in Ukraine — by the Ministry of Justice, the MVD, the Ministry of Education and Science or the MFA, depending on the document type. Spain does not place apostilles on foreign documents, so a Ukrainian certificate cannot be apostilled at any Spanish office. Authenticity is confirmed through the official Ukrainian register of apostilles.
The legal basis is the same as for the paper apostille: the Convention of 5 October 1961 of the Hague Conference on Private International Law, which abolished the requirement of legalisation for foreign public documents between contracting states. Ukraine has been a party to the convention since 2003, so Ukrainian public documents travel to Spain with an apostille rather than full legalisation. Within the EU, Regulation (EU) 2016/1191 facilitates the circulation of public documents between member states, but it does not remove the apostille requirement for documents coming from Ukraine. Which Ukrainian documents can be apostilled
An apostille can be placed on most official Ukrainian documents: civil status certificates (birth, marriage, divorce, name change) issued by DRATS offices, notarial documents, court documents, criminal record certificates, and educational documents such as diplomas and school certificates. The electronic apostille works only for documents that exist in electronic form and carry a qualified electronic signature of the issuing authority — in practice, above all documents ordered through the Diia portal, such as the criminal record extract.
Some documents do not qualify for the electronic route. Paper-only certificates, documents produced by private entities, and most academic credentials still travel the paper route, where the apostille is a separate certificate stamped or attached to the document. Which Ukrainian ministry handles it depends on the document type: the Ministry of Justice of Ukraine for civil status, notarial and court documents; the MVD of Ukraine for criminal record certificates; the Ministry of Education and Science of Ukraine for diplomas and school documents; the MFA of Ukraine for other official documents. If you are unsure, start from the issuing body — the apostille authority follows the document, not your preferences.
One scenario comes up often: marriage registration in Spain. The Registro Civil normally asks for a Ukrainian birth certificate and, where relevant, a marriage or divorce certificate from Ukraine, each apostilled in Ukraine and accompanied by a sworn translation. Residence procedures at Extranjería similarly call for an apostilled criminal record extract, and university admission requires apostilled diplomas. In all of these cases the apostille is obtained in Ukraine, and the Spanish authority only consumes the finished result.
How to get the apostille in Ukraine
The application is submitted to the competent Ukrainian authority — in person at its office in Ukraine, through a representative acting under a notarised power of attorney, or, for eligible electronic documents, through the e-apostille route. The steps below cover the typical path.
-
Identify the competent authority. Civil status certificates from DRATS, notarial and court documents go to the Ministry of Justice of Ukraine; criminal record certificates to the MVD; diplomas and school documents to the Ministry of Education and Science; other official documents to the MFA.
-
Obtain the document. Order a fresh Ukrainian original — a civil status record from a DRATS office, a criminal record extract through Diia, or a duplicate diploma. The apostille is placed on the document issued in Ukraine, not on a photocopy.
-
Submit the application. Apply in person, through your representative, or electronically where the route is available, and pay the official fee. Double-check every field, since errors can delay processing.
-
Wait for issuance. The competent Ukrainian ministry reviews the request and places the apostille once the review is complete. Processing time varies by authority and workload, so build in a buffer of several weeks.
-
Receive and check. Collect the apostilled original or download the electronically signed files, and verify the entry in the Ukrainian apostille register before sending the document to Spain.
How to receive the e-apostille and what you get
The issued e-apostille is a set of electronic files signed with a qualified electronic signature, not a stamped paper certificate. For eligible Ukrainian documents the whole chain stays digital: the document is issued electronically, and the apostille is electronic too.
On the paper route you receive the original document with the apostille certificate attached. Keep the registration details of the apostille — the number and date recorded in the Ukrainian register. They are your key to verification later, and Spanish authorities or their translators may use them to confirm the apostille before accepting the document. Store them somewhere safe.
How to verify an apostille on a Ukrainian document
Verification happens on two levels, and the receiving party may use either.
- Register check. Every apostille is recorded in the official Ukrainian register — the Unified Register of Special Notarial Acts — with its registration number and date. Anyone can consult the register online to confirm the apostille exists and matches the document.
- Signature validation. On the e-apostille, the qualified electronic signature on the files can be checked with standard validation tools. The check confirms the signature was applied by the competent Ukrainian authority and that the files have not been altered.
Verification from Spain runs through the same register. The Spanish institution receiving the document — a Registro Civil, an Extranjería office or a university — can check the apostille online, which removes any need for physical contact with the Ukrainian ministry. A detailed walkthrough of the checks on the Spanish side is in How to Verify an Apostille Issued for Sp.
e-Apostille vs paper apostille
| Aspect | e-Apostille | Paper apostille |
|---|---|---|
| Format | Files with qualified electronic signature | Physical certificate with stamp |
| Typical Ukrainian documents | Electronic documents such as the Diia criminal record extract | DRATS certificates, diplomas, notarial documents |
| Issuing body | Competent Ukrainian ministry (Justice, MVD, MES, MFA) | Competent Ukrainian ministry (Justice, MVD, MES, MFA) |
| Application | Electronic route where available | In person in Ukraine or via a representative |
| Verification | Ukrainian apostille register + signature check | Register check / physical inspection |
| Fee | Official fee applies | Official fee applies |
| Acceptance | Authorities accepting electronic apostilles | All Hague Convention contracting states |
The last row is the practical takeaway: a paper apostille is accepted across all Hague Convention states, while the electronic route depends on the receiving authority accepting digital documents. Spanish bodies vary in what they accept, so check with the Registro Civil, Extranjería or the university before choosing the route.
Case: an apostilled criminal record extract for Extranjería
Situation. A Ukrainian citizen in Madrid needed a criminal record extract for a residence procedure at Extranjería. She was already in Spain, the extract was ordered through Diia in Ukraine, and the appointment at the immigration office was approaching fast.
Steps. The extract was issued electronically with a qualified electronic signature, so the e-apostille route was open. The apostille was obtained electronically in Ukraine, the signed files were downloaded, and the entry was checked in the Ukrainian apostille register. A sworn translator from the MAEC list then translated the package into Spanish.
Result. The digitally signed extract with its electronic apostille and sworn translation was submitted to Extranjería as a verified digital package, with no extra trip to Ukraine at any stage.
FAQ
No. Under the Hague Apostille Convention, the apostille is placed by the state that issued the document. A Ukrainian birth, marriage or criminal record certificate must be apostilled in Ukraine by the competent Ukrainian ministry; Spanish authorities only accept the finished apostille.
The Ministry of Justice of Ukraine handles civil status certificates issued by DRATS offices, notarial and court documents. The MVD of Ukraine apostilles criminal record certificates, the Ministry of Education and Science apostilles diplomas and school documents, and the MFA covers other official documents.
It is the electronic version of the apostille for documents that exist in electronic form and carry a qualified electronic signature, such as the criminal record extract ordered through Diia. Instead of a stamp, you receive electronically signed files that can be verified online.
No, the apostille itself has no expiry date. However, the receiving institution in Spain may require the underlying document to be recent — criminal record extracts in particular are usually expected to be fresh.
Yes. Spanish authorities normally require a translation into Spanish by a sworn translator certified by the Spanish Ministry of Foreign Affairs (the MAEC list). The apostille confirms the signature in Ukraine; the sworn translation makes the document usable in Spain.
It depends on the purpose: civil status certificates go to the Registro Civil for marriage or registration, criminal record extracts to Extranjería for residence procedures, and diplomas to universities or recognition bodies.
The apostille must be obtained in Ukraine, but you do not necessarily have to travel: a relative or a representative in Ukraine can usually act for you with a notarised power of attorney, and some documents can be ordered electronically.
As a rule, receiving institutions require the apostilled original or, on the electronic route, the digitally signed files. A simple photocopy of an apostilled document is normally not accepted as a substitute.
How the process works
- Identify the competent Ukrainian authority
The Ministry of Justice of Ukraine apostilles civil status certificates from DRATS offices, notarial and court documents; the MVD handles criminal record certificates, the Ministry of Education and Science handles diplomas, and the MFA covers other official documents.
- Obtain the document in the right form
Order a fresh civil status certificate from a DRATS office, a criminal record extract through Diia, or a duplicate diploma — the apostille is placed on a document issued in Ukraine, not in Spain.
- Apply for the apostille in Ukraine
Submit the document to the competent Ukrainian ministry in person, through a representative with a power of attorney, or through the electronic route where the document qualifies for an e-apostille.
- Receive the apostilled document
On the electronic route you receive files signed with a qualified electronic signature; on the paper route, the original document with the apostille certificate attached.
- Prepare the document for Spain
Order a sworn translation by a translator certified for Spanish (traductor jurado) and submit the package to the Registro Civil, Extranjería or the university.
