An apostille confirms the origin of a public document so it is accepted abroad. It was introduced by the Convention of 5 October 1961, known in Spain as the Apostilla de la Haya, and more than a hundred countries apply it, Spain among them. If you were born abroad and your birth certificate must go to the Civil Register in Spain, the apostille is usually what makes it valid. The same applies when you present a foreign diploma to an employer.

Apostille vs Traditional Legalisation
The apostille replaces a chain of certifications with a single stamp or electronic record. Traditional legalisation means getting signatures confirmed by several authorities and then by the consulate of the destination country. Between countries that apply the Hague Convention, including the US and the UK, that chain is unnecessary: one apostille is enough.

Competent Authorities: Who Issues the Apostille
Which office apostilles your document depends on its type, and this is where many applications stall.

The Online e-Apostille Procedure Step by Step
The e-Apostille (Apostilla electrónica) lets you complete the entire process without visiting an office. The flow through the Ministerio de Justicia looks like this:
- Identify yourself with a digital certificate or another accepted online method.
- Fill in the application in the electronic office and attach the digitally signed document.
- Generate and pay the fee using modelo 046, then attach the receipt.
- Wait for the authority to review and issue the apostille.
- Download the electronically signed PDF.

Download Window and Validity
Two different time questions matter here, and they are often confused.
The apostille itself does not expire. Once issued, the certificate stays valid; there is no expiry date printed on it. What can expire is the acceptance of the underlying document: some Spanish bodies want a civil status certificate issued recently, so check the requirement of the office you are filing with.
The download window is limited. Once the e-Apostille is issued, the PDF stays available only for the period set by the electronic office. If that window closes, you usually have to file a new access request instead of reusing the old link. A simple habit helps: download the file the same day the notification arrives, then keep the PDF and its verification code together in one place.
Verifying Authenticity: CSV, Signature and Integrity
Anyone receiving your apostilled document can check it in three layers:
- CSV check. Enter the secure verification code printed on the apostille into the verification service of the issuing authority. Add the apostille number and date if the service asks for them.
- Digital signature validation. Open the PDF in a standard signature-validation tool. This confirms the e-Apostille was signed by the authority and the signature is valid.
- Document integrity. Validation also shows whether the apostilled PDF was altered after signing. If the hash matches, the content is intact.

UK and US Documents for Spain
UK after Brexit the apostille rules stayed the same. The UK is still a Hague member, so a certificate from the General Register Office only needs an apostille from the UK legalisation office, and consular legalisation is not required. US documents work on the same principle. The apostille is issued at state level by the Secretary of State of the state where the document originated, while federal documents such as FBI background checks are legalised by the US Department of State.
When the Apostille Is Not Required
Documents issued inside the European Union are exempt from apostille under EU rules on the circulation of public documents between member states. A Spanish authority generally accepts an EU-issued certificate without an apostille, though it may still ask for a translation. This is the main exception people overlook when they order an apostille they don’t need.
Sworn Translation After the Apostille
An apostille only confirms the document’s origin; it does not translate a word of it. If your apostilled certificate is in German rather than Spanish, Spanish authorities will normally ask for a sworn translation (traducción jurada) done by a translator certified by the Spanish Ministry of Foreign Affairs, European Union and Cooperation. Order the translation after apostilling, because the translator must work from the final version that includes the apostille itself.
Case: Marriage in Spain with a UK Certificate
Situation. A UK citizen marrying in Spain needs to present a birth certificate to the Civil Register.
Steps. Start by ordering a certified copy from the General Register Office. Next, obtain a UK apostille for it, commission a sworn Spanish translation, and book an appointment at the Civil Register to file the documents. If the registrar asks for extra proof of marital status, a Foreign Marriage Recognition Certificate can be obtained in the UK and apostilled in the same way.
Result. The complete chain, certificate, apostille, translation, is what the registrar actually accepts; presenting a bare certificate without the apostille or translation leads to rejection.

Legalisation is a chain of certifications through several authorities, ending with the consulate of the destination country. The Hague Apostille is a single certificate issued under the Convention of 5 October 1961, and it replaces that whole chain between countries that participate in the Convention.
Foreign public documents such as birth, marriage and death certificates, court decisions, notarial acts and administrative certificates generally need an apostille or legalisation to be accepted by Spanish authorities, for example the Civil Register.
Usually no. Spanish bodies normally require the apostilled original or an electronically signed document. Photocopies may be accepted only when they are certified copies or when the specific procedure explicitly allows them.
The apostille itself does not expire. However, the authority requesting the document may require the underlying certificate to be recent, so always check the recency rules of the body you are filing with.

How the process works
- Confirm which authority issues your apostille
For Spanish documents, most civil status and administrative records go through the Ministerio de Justicia. Notarised documents are handled by the relevant Notary Colleges, and consular or foreign affairs documents by the Ministry of Foreign Affairs, European Union and Cooperation.
- Prepare the document in the correct form
For an electronic apostille you need a digital version of the document issued by a body that can sign it electronically. Paper-only documents must be scanned or digitalised first, and some require a certified copy.
- Submit the online application
File the request through the electronic office of the issuing authority, identify yourself with the accepted digital certificate or cl@ve method, and attach the document.
- Pay the fee
For the Ministerio de Justicia, the fee is paid using form modelo 046, and the payment receipt is attached to the application.
- Download the e-Apostille
Once issued, you receive a PDF signed electronically. Download it within the availability window; after that you may need to request access again.
- Verify and forward the file
Check the secure verification code and the digital signature, then send the apostilled PDF to whoever requested it in Spain, together with a sworn translation if needed.
